1. Introduction

CodeAdvocate ("we," "our," or "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond to clear notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

This DMCA Takedown Policy describes the process for reporting copyright infringement on our Service and how we handle such reports. This policy is part of our commitment to protecting intellectual property rights while providing a platform for developers to share and collaborate on code.

This policy should be read together with our Terms of Service and Privacy Policy.

2. DMCA Overview

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a safe harbor for online service providers from copyright infringement liability, provided they comply with certain requirements, including:

  • Designating an agent to receive notifications of claimed infringement
  • Responding expeditiously to valid takedown notices
  • Removing or disabling access to allegedly infringing material
  • Implementing a policy for terminating repeat infringers
  • Providing a process for counter-notifications

CodeAdvocate complies with the DMCA and has implemented the procedures described in this policy to address claims of copyright infringement.

3. Our Commitment to Intellectual Property

We take intellectual property rights seriously and are committed to:

  • Respecting the intellectual property rights of copyright owners
  • Responding promptly to valid DMCA takedown notices
  • Providing a fair process for users to dispute takedown notices
  • Protecting users from false or fraudulent takedown notices
  • Maintaining transparency in our takedown process
  • Complying with applicable copyright laws and regulations

However, we are not in a position to adjudicate disputes between copyright owners and users. Our role is limited to responding to valid DMCA notices and providing a process for counter-notifications, as required by law.

4. Filing a DMCA Takedown Notice

If you believe that content on CodeAdvocate infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be valid, your notice must comply with the requirements of the DMCA and include all of the information specified below.

4.1. Required Information

Your DMCA takedown notice must include the following information:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. This should include:
    • Specific URLs or links to the allegedly infringing content
    • User account names or identifiers associated with the content
    • Repository names or identifiers (if applicable)
    • Any other information that will help us locate the content
  4. Contact Information: Your contact information, including:
    • Your full name
    • Your mailing address
    • Your telephone number
    • Your email address
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4.2. Submission Process

DMCA takedown notices must be submitted to our designated agent using one of the following methods:

  • Email: Send your notice to dmca@codeadvocate.com
  • Mail: Send your notice to our designated agent at the address provided in the "Designated Agent Information" section below
  • Online Form: Use our contact form and select "DMCA Takedown Request" as the subject

Important: Please ensure that your notice includes all required information. Incomplete notices may delay our response or may not be processed.

4.3. What Happens After Submission

After we receive your DMCA takedown notice:

  1. Review: We will review your notice to ensure it contains all required information and complies with the DMCA.
  2. Verification: We may contact you to verify your identity or request additional information if needed.
  3. Action: If your notice is valid, we will:
    • Remove or disable access to the allegedly infringing material
    • Notify the user who posted the content about the takedown
    • Provide the user with information about the counter-notification process
  4. Confirmation: We will send you a confirmation email once we have taken action on your notice.

We typically respond to valid DMCA notices within 48-72 hours. However, response times may vary depending on the complexity of the case and the volume of requests we receive.

5. Counter-Notification

If you believe that your content was removed in error, you may file a counter-notification. A counter-notification is a request to restore content that was removed due to a DMCA takedown notice.

Important: Filing a counter-notification is a serious matter. You should only file a counter-notification if you have a good faith belief that your content was removed by mistake or misidentification. False counter-notifications may result in legal liability.

5.1. Counter-Notification Requirements

Your counter-notification must include the following information:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Removed Content: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Contact Information: Your name, address, and telephone number.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which CodeAdvocate may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

5.2. Counter-Notification Process

After we receive your counter-notification:

  1. Review: We will review your counter-notification to ensure it contains all required information.
  2. Forward: We will forward your counter-notification to the person who filed the original DMCA notice.
  3. Waiting Period: We will wait 10 business days from the date we forward your counter-notification.
  4. Restoration: If the original complainant does not file a court action against you within 10 business days, we may restore the removed content.
  5. Notification: We will notify you of the outcome.

Important: If the original complainant files a court action against you within 10 business days, we will not restore the content and will comply with any court orders.

6. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. A user is considered a repeat infringer if they have been the subject of multiple valid DMCA takedown notices.

In determining whether to terminate an account, we consider factors such as:

  • The number and severity of copyright violations
  • Whether the violations were intentional or unintentional
  • Whether the user has taken steps to prevent future violations
  • The user's overall conduct on our Service

We reserve the right to terminate accounts at any time for repeat infringement, in our sole discretion.

7. False or Fraudulent Notifications

The DMCA provides penalties for false or fraudulent takedown notices. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney's fees.

If you file a DMCA takedown notice, you should:

  • Only file notices for content that you genuinely believe infringes your copyright
  • Ensure that all information in your notice is accurate
  • Have a good faith belief that the use of the material is not authorized
  • Be authorized to act on behalf of the copyright owner

We may share information about false or fraudulent notices with the affected users and may take legal action against persons who file false notices.
